Texas is suing OpenAI over ChatGPT safety regulations

The state of Texas has filed a lawsuit against OpenAI, the creator of ChatGPT, claiming that the company misled users about the safety of its popular AI chatbot. State leadership says that OpenAI is in violation of online safety laws and should be held accountable.

The lawsuit against OpenAI was filed by Texas Attorney General Ken Paxton, as Politico reported. In it, the company accuses OpenAI of failing to protect users and falsely informing them about the safety of ChatGPT. “With the rapid advancement of AI technology, OpenAI has the responsibility to protect users and warn them of the many dangers of its platform,” said Paxton in a statement. “I will fight to protect Texans from the harms of AI and ensure that powerful technology companies are not above the law.”

The lawsuit outlines several offenses allegedly made by OpenAI. One given example is the phenomenon of ChatGPT users using the app to diagnose themselves of various diseases, illnesses, and health conditions. The lawsuit cites a February 2026 study that says ChatGPT is just as likely to misdiagnose a person as the person is to misdiagnose themself. Two anonymous ChatGPT users both shared symptoms of a subarachnoid hemorrhage, but were given conflicting advice on how to handle it.

The lawsuit requests that OpenAI be restricted from offering chatGPT to minors in Texas, and that new ChatGPT models be approved by a third-party before release in the state. It’s the latest in what has become a streak of lawsuits and other legal engagements regarding AI technology.
